Texas Puts a Second Gate on AI Campuses as Environmental Permits Join the Grid Freeze
Governor Abbott ordered TCEQ to halt all data-center permits until ERCOT finishes its audit, expanding August’s interconnection pause to catch behind-the-meter and smaller projects – while Google backs Georgia nuclear uprates and junk-bond buyers get a CoreWeave-leased Virginia campus.
Today’s Signals
- Abbott/TCEQ Halt – Sep 21 letter directs TCEQ to pause all data-center permits until ERCOT completes its audit; TCEQ compliance update due Oct 19.
- ERCOT Impact RFI – Developers of 25 MW+ data centers must file notarized responses by 5 p.m. CPT Oct 12; joint report targeted by Dec 10.
- Google + Georgia Nuclear – Georgia Power files NU-1 tariff and Hatch EPU; ~96 MW uprates; ~$900M projected customer benefits; PSC approval pending.
- Digital Drive HY Bond – Goldman-led banks market ~$1.1B junk bonds for Blue Owl-sponsored 76 MW VA campus fully leased to CoreWeave (15-yr / $2.94B); price eyed Sep 23.
- Nscale S-1 – Filed Sep 18 for NYSE “NSCL”; prospectus coverage cites $44.6B Anthropic deal for ~460 MW Monarch WV on-prem microgrid.
The Big Story
Texas just turned environmental permitting into a second choke point on AI campus delivery. On September 21, Governor Greg Abbott directed Texas Commission on Environmental Quality Executive Director Kelly Keel to pause issuance of all permits related to data-center projects until ERCOT completes its review. The letter follows August’s PUC/ERCOT interconnection audit – which ERCOT could only apply to grid connections at roughly 75 MW and above – and September’s TWDB water-reporting enforcement push. The TCEQ gate matters because air and water permits, and onsite generation authorizations, reach behind-the-meter and smaller projects that never hit the ERCOT interconnection freeze. Abbott also said he will work with the Legislature to eliminate financial incentives for data centers. Label carefully: a governor’s directive and agency pause, not a statute, with TCEQ told to update compliance by October 19 and ERCOT still targeting a December audit report. The throughline is delivery risk: state politics and multi-agency audits now throttle campuses while capital and nuclear deals keep buying electrons elsewhere.
AI
Keep the AI desk on contracted compute and where the campuses sit. On September 18, Nscale Limited filed a Form S-1 for a proposed NYSE listing under “NSCL,” with share count and price range still undetermined. Readable coverage of the prospectus cites a $44.6 billion Anthropic infrastructure deal for about 460 MW at Monarch in West Virginia – framed as an on-premises microgrid campus with an expansion path claimed above 8 GW – plus Microsoft GPU hosting and about 461,000 active and contracted GPUs on the books. Nscale also discloses plans for a roughly $1.85 billion, 200 MW campus in Ward County, Texas, and a $1.2 billion Madison, North Carolina upgrade. Filing is not pricing: the registration is not effective, and Anthropic TCV is contracted capacity, not current revenue.
Money
Capital is still underwriting AI halls even as Texas slows the permit clock. Bloomberg-sourced market chatter dated September 21-22 says Goldman Sachs-led banks began marketing about $1.1 billion of high-yield bonds for Digital Drive near Richmond, Virginia – a Blue Owl affiliate-sponsored project with 76 MW of IT capacity fully leased to CoreWeave under a 15-year, $2.94 billion contract, ops eyed 2027-2028, price talk early-week with a call Tuesday. Separately, CleanSpark’s CSDC Finance I priced $2.276 billion of 7.875% senior secured notes due 2031 at 98.500%, expected close September 25, to finish Sandersville; priced is not funded until closing. Accelevation launched its ACCV roadshow September 22 for 30 million Class A shares at a $20-$24 range – registration not yet effective.
Power
Elsewhere, hyperscalers are buying megawatts by uprating existing nuclear rather than waiting on new interconnects. On September 21, Georgia Power and Google announced a PSC-subject agreement under which Google will support extended power uprates on Georgia Power’s owned share of Plants Vogtle and Hatch, adding about 96 MW for Georgia Power customers. Filings in Dockets 44280 and 56002 include a new Nuclear Uprate (NU-1) tariff and an EPU request for Hatch 1 and 2; Vogtle’s EPU was already approved in the 2025 IRP. Google subscribes to NU-1 and receives Zero-Emission Credits on the uprate output; Georgia Power projects about $900 million in customer benefits over the units’ lives and says the structure is designed to shield non-participating customers from incremental uprate costs. Pending approval – not online megawatts.
Government Power
The Texas stack is now whole-of-government, not a single ERCOT queue memo. Abbott’s August 3 directive ordered PUC and ERCOT to audit data centers before interconnection advances, citing roughly 474 GW of interconnection requests – about 90% data centers – more than five times record peak. ERCOT’s September 14 State and Community Impact RFI covers Batch Zero loads plus 25-75 MW medium loads; notarized responses are due 5 p.m. CPT October 12, with a joint report targeted by December 10. TCEQ confirmed it has paused air and water permits for infrastructure directly supporting data centers while that audit runs. Virginia’s September 18 EO-22 remains the other state signal – accountability without a moratorium – while Congress still lacks a national who-pays statute. Directive plus agency pause, not enacted Texas statute.
AMP Bottom Line
Texas just proved the binding constraint is no longer only electrons or interconnection studies – it is political permission. A governor’s letter can freeze environmental permits the same week capital markets price a CoreWeave-leased Virginia bond and Google buys nuclear uprate attributes in Georgia. The tension is geography and sequence: balance sheets will keep shopping for megawatts in friendlier docks while the largest U.S. AI pipeline state writes the rulebook in reverse.
